A Shirley man was charged with impaired driving and driving over 100 mph immediately before an April crash in Bayport that injured him and a passenger, Suffolk police said.

Police said Mario Auer, 25, was charged Monday with driving while ability impaired by drugs, reckless endangerment, reckless driving and speeding.

Police said Auer was driving a 2022 BMW east on Sunrise Highway, west of Nicolls Road, when he lost control of the vehicle, crashing into the center median at about 1:10 p.m. on April 28. The crash caused both Auer and his passenger, a 28-year-old woman, to be ejected from the vehicle.

The woman was transported to NYU Langone Hospital—Suffolk in Patchogue, where she was treated for what police described as minor injuries.

Auer was taken to Stony Brook University Hospital for treatment of what police called "serious but non-life-threatening injuries."

He will be arraigned Monday in First District Court in Central Islip.

Police did not release additional information on the investigation findings. It was not immediately clear if Auer is represented by counsel.
